Introduction and Acceptance

Nirajdev Shop is an e-commerce website operated by NIRAJDEV COMMODITY TRADERS PRIVATE LIMITED. References in these Terms to “we”, “us”, “our”, “Company” or “Nirajdev Shop” refer to NIRAJDEV COMMODITY TRADERS PRIVATE LIMITED, as applicable.

“You”, “your”, “customer” or “user” refers to the person accessing the website or purchasing products through it.

These Terms apply to your use of the website and to transactions entered into through the website, subject to applicable Indian law.

Placing and Acceptance of Orders

Adding a product to the cart does not reserve stock or guarantee that the product will remain available.

An automated acknowledgement or payment confirmation does not necessarily mean that every product in the order has been finally accepted for fulfilment.

We may be unable to fulfil an order because of stock unavailability, delivery restrictions, incorrect information, payment failure, suspected fraud, product withdrawal or other legitimate reasons.

Where a paid order or item cannot be supplied, the applicable amount will be dealt with in accordance with our Refund & Cancellation Policy and applicable law.

Shipping and Delivery

Delivery estimates are estimates rather than guarantees unless applicable law or an express commitment provides otherwise. Delivery may be affected by logistics, weather, public holidays, strikes, transport disruption, regulatory restrictions or other circumstances.

Order Cancellation

Cancellation eligibility depends on the stage of the order, the nature of the product and our applicable Refund & Cancellation Policy.

An order may no longer be cancellable after processing, packing, dispatch or other fulfilment milestones where cancellation is no longer operationally possible, subject always to applicable consumer rights.

We may cancel all or part of an order where fulfilment is not possible for legitimate reasons including unavailable stock, payment failure, technical error, invalid delivery information or suspected fraudulent activity.

Returns, Replacements and Refunds

Food and grocery products may require special handling because of hygiene, perishability, tamper-evident packaging, shelf life and food-safety considerations.

Return or replacement eligibility is therefore determined according to the condition of the product, the reason for the request, applicable law and our published Return and Refund policies.

Nothing in these Terms prevents a customer from raising a legitimate complaint where goods are defective, damaged, materially different from the description, incorrect, unsafe or otherwise give rise to rights under applicable law.

Damaged, Incorrect or Problematic Products

If you receive a product that is damaged, leaking, materially defective, incorrect or otherwise has a genuine fulfilment problem, contact us as soon as reasonably possible after delivery.

To help us review a claim, we may reasonably request:

• Order number.
• Name of the affected product.
• Clear photographs or video showing the issue.
• Images of outer and inner packaging where relevant.
• Batch, manufacturing, best-before or other label information where relevant to the complaint.
• A description of the issue experienced.

Such information is used to verify and resolve the request and does not automatically determine or limit any statutory rights.

Storage, Handling and Consumption

After delivery, customers should store and handle food products according to the instructions printed on the relevant package.

Depending on the product, storage instructions may require a cool, dry place, protection from moisture or sunlight, airtight storage after opening or other specific conditions.

Customers should not consume food products that appear unsafe, contaminated, improperly sealed or otherwise unsuitable for consumption.

Always check applicable best-before, use-by or expiry information on the product received.

• Other applicable tax, contract, payment, consumer and e-commerce requirements.

Changes to These Terms

We may update these Terms when reasonably necessary to reflect changes in our products, website functions, policies, business practices or applicable law.

Updated Terms may be posted on this page together with a revised “Last Updated” date.

Changes will operate subject to applicable law and will not retrospectively remove rights already accrued to customers where such removal is not legally permitted.
